Alice van der Schee has been at Van Benthem & Keulen since 1990, working as a lawyer and partner in the Restructuring & Insolvency team, which she heads. Alice is often appointed as an administrator in moratoriums and as trustee and receiver in bankruptcies. These have included such high-profile bankruptcies as MC IJsselmeerziekenhuizen B.V., TCN Urop SE and Koops Furness N.V.

In addition, Alice advises and assists entrepreneurs and their creditors in the context of composition procedures under the Dutch Court Approval of a Private Composition (Prevention of Insolvency) Act ("WHOA").

Furthermore, Alice specialises in assisting other trustees and receivers in conducting and coordinating extensive cause and lawfulness investigations in bankruptcies. She also handles liability proceedings (which can be complex) against directors, supervisory directors and auditors, in which she assists both the trustees/receivers and their counterparties. These include any disciplinary proceedings that may precede a liability claim.

One of the qualities that set Alice apart as a lawyer is that she is bilingual. She is also a Rechtsanwältin in Germany. This allows her to guide her German clients through the Dutch legal system. At the same time, she is able to explain to Dutch entrepreneurs operating in Germany the differences between the two legal systems, while her knowledge of German culture allows her to offer appropriate solutions.

About Alice van der Schee

In addition to her job as a lawyer, Alice is an active member of several associations, and holds several external positions, writes publications, and is a regular guest as an expert in our podcast "Licht op Legal" ("Light on Legal").

External positions

INSOLAD: Alice served on the board of INSOLAD (Dutch Insolvency Lawyers Association) from 2009 to 2016. In 2020, Alice joined INSOLAD's Review Committee (disciplinary committee), of which she is currently chair.

INSOL Europe: Member of the Council of INSOL Europe since 2016, joined the Executive of INSOL Europe in 2022.

Deutsch-Niederländische Rechtsanwaltsvereinigung: from 2014 to 2016, Alice served as chairman of the board.

SCG Legal: from 2014 to 2022, Alice was a member of the Board of Directors of SCG Legal, and also served on the Executive of SCG Legal from 2016 to 2021.

Alice is also an (active) member of the following associations: TMA Netherlands, the NVRII (Dutch Association for Comparative and International Insolvency Law), the Arbeitsgemeinschaft Insolvenzrecht und Sanierung of the Deutscher Anwaltverein, the Dutch Corporate Litigation Association and the Dutch Accounting Law Association.
