Not all discharges are the same
06-11-2018
In Bedrijfsjuridische berichten (Bb) 2018/73, Marcel Ruygvoorn wrote the article "Not all discharges are the same".
Lawyers regularly grant discharge. But what does "discharge" in a legal sense mean? And what are the legal consequences of "discharge" granted? And in the context of that second question: what happens if I have made a mistake when granting discharge and the debt for which I granted discharge has not been fully paid off? The judgement Marcel discusses in this article centres on this last question.
